The Worlds of the Trust: une nouvelle publication au Centre Crépeau

Nous sommes heureux d'annoncer que une nouvelle publication au Centre Crépeau: The Worlds of the Trust (Cambridge University Press, 2013), une collection éditée par le professeur Lionel Smith.

Cette collection de 22 essais contribue de façon significative à l’étude comparative des fiducies. Elle inclut des contributions du Canada, des États-Unis, de l’Angleterre, de la France, de l’Écosse, de l’Afrique du Sud, d’Israël et de la Chine.

Par ailleurs, cet ouvrage compte parmi plusieurs publications résultant d’un projet de recherche substantiel sur les fiducies dans les juridictions civiles et mixtes, dont Re-imagining the Trust: Trusts in Civil Law (Cambridge University Press, 2012), qui également été dirigé par le professeur Smith, et un numéro spécial de la Revue de droit de McGill (volume 58, no. 4).

(En anglais seulement) Despite the common belief that they are found only in the common law tradition, trusts have long been known in mixed jurisdictions even where they have a civilian law of property. Trusts have now been introduced by legislation in a number of civilian jurisdictions, such as France and China. Other recent developments include the reception of foreign trusts through private international law in Italy and Switzerland and the inclusion of a chapter on trusts in Europe's Draft Common Frame of Reference. As a result, there is a growing interest in the ways in which the trust can be accommodated in civil law systems. This collection explores this question, as well as general issues such as the juridical nature of the trust, the role and qualifications of the trustee and particular developments in specific jurisdictions.
