Recent Publication by Professor Ram Jakhu and Nishith Mishra

The Institute of Air and Space is pleased to announce the publication of a research essay by our Prof. Ram Jakhu and IASL Doctoral Candidate, Nishith Mishra titled ‘The Beginning of the End of International Space Law’. This Chapter has been published in a collection of essays honouring Prof. Dr. Siegfried Wiessner, and has been published as part of a book titled “Human Flourishing: The End of Law” which has been edited by Prof. W. Michael Reisman & Prof. Roza Pati.

In choosing a rather provocative title for the research essay, the authors have highlighted and analysed a wide variety of factors and circumstances that are currently contributing, and have contributed, towards the gradual decline in multilateralism in international space law-making. The focus here is not in any specific issue of international space law but towards a larger and more fundamental subject of ongoing ‘challenges’ to the global space governance framework. The authors, through their research work, have attempted to analyse and present several developments and trends during the last couple of decades that have turned the tide of international concerns and relations towards a more individualistic, nationalist and unilateral approach to address­ing issues of global concern.

In using the phrase ‘beginning of the end’, the authors do not in any way imply that the end is not stoppable. Rather, it is an urgent call to the international community to take appropriate actions and timely recourses. In a world that is rapidly moving towards a multi-polar global order, law needs to be maintained and viewed as an evolving process. If the rule of law is allowed to end or be significantly weakened in the space domain, the freedom of exploration and use of outer space ‘by all and for the benefit of all’ will significantly diminish. In the broader scheme of things, this is likely to effect sustainable use of outer space and is also likely to present serious concerns, or threats, to international peace and security.

9th McGill Annual Strategic Space Law Course a success

On 24-27 October 2023, the McGill Institute and Centre for Research in Air and Space Law held the ninth edition of the Annual Strategic Space Law Course online. Organised in cooperation with Spectrum Space Security Inc., headed by IASL graduate Mr. Gilles Doucet, and coordinated by Managing Editor of the McGill Manual on International Law Applicable to Military Uses of Outer Space Mr. Kuan-Wei Chen, the Course this year attracted over fifty participants from across the globe. At the conclusion of the course, participants were each awarded a Certificate of Participation.

The annual Strategic Space Law Course is designed to provide legal and policy professionals and students with a solid understanding of the strategic and economic value of space, and the applicable rules of international law that govern security and commercial activities in outer space. Over the span of four days, some of the most renowned subject-matter experts and practitioners in the world provided participants with engaging lectures and much food for thought in the interactive Q&A session following each lecture.

At start of the Course, Institute Co-Director Professor Andrea Harrington welcomed the participants on behalf of the Institute. In addition to foundational lectures on the international and national regulation of space activities, the Course covered a wide range of topics including the technical and operational aspects of the military use of space, commercial-military space transactions, norms of responsible behaviour in outer space, strategic challenges of large satellite constellations, cybersecurity policy and standards for space operations, and the application of the law of armed conflict in the event of hostilities in space.

As the world's first course focusing on various legal and policy considerations surrounding the strategic uses of outer space, the Strategic Space Law course has been organised by the IASL since 2014. Its continuing success for close to a decade is testament to the growing demand for legal training and knowledge on a variety of issues and challenges that space operators, legal professionals and policy advisers may be expected to grapple with in the space domain.

In-person sessions of the Strategic Space Law Course are planned in the near future, which will provide valuable opportunities for participants to learn from seasoned lecturers as well as network with other professionals in the bourgeoning space industry.

 


IASL Associate Director attends Cape Town Convention Conference in Cambridge

On 27 September, IASL Associate Director, Prof. Donal Hanley presented a paper on Leasing and the Cape Town Convention at the Cape Town Convention Academic Conference hosted by Professor Louise Gullifer at Jesus College, Cambridge, together with Professor Ignacio Tirado, Secretary General of UNIDROIT and Jeffrey Wool, Secretary General of the Aviation Working Group. The presentation was followed by commentaries from Ravi Nath of RNC Legal, Nitin Sarin of Sarin & Co., and Professor Charles Mooney of University of Pennsylvania Law School.

IASL Co-Director Prof. Andrea Harrington in Washington DC

On 26 September, IASL Co-Director Prof. Andrea Harrington travelled to Washington DC to provide a lecture about the development and use of international institutions with a focus on space security and space safety to a cohort of students enrolled in the Master of International Public Policy program at the Johns Hopkins University School of Advanced International Studies campus. She delivered the lecture and then participated in the three seminar discussions in the brand new JHU facility at 555 Pennsylvania avenue, which opened last month.

Welcome Luncheon for the New Cohort

The day commenced with a Welcome Luncheon, inviting the incoming cohort of students to embark on their educational journey in the field of air and space law. The luncheon served as a platform for students to acquaint themselves with faculty members and their peers, setting the stage for a thriving academic community. Like in the past, the Institute continues its history of welcoming a truly international cohort of students hailing from Taiwan, Germany, Argentina, US, Indonesia, Sweden, UK, Japan, Colombia, Italy, Hong Kong, China, India and Canada.

During the luncheon students were given the opportunity to meet their peers and the Institute, which was represented by the two Co-Directors, Prof. Andrea Harrington and Prof. Vincent Correia, Associate Director, Prof. Donal Hanley, Executive Director, Stefan-Michael Wedenig, Editor of the Annals of Air and Space Law, Jack Wright Nelson together with Associate Editor, Arnold Agaba and Senior Administrative Coordinator, Sonia De Riggi.

The Institute was also delighted to welcome Prof. Martine De Serres (IASL Adjunct Professor) and George Petsikas (IASL Sessional Lecturer) to the luncheon where they shared their experience working in the Aviation industry.

Welcome Reception in Honor of Maria D'Amico and Prof. Brian Havel

In the evening, the Institute hosted a reception, paying tribute to two exceptional individuals whose contributions have been indispensable to the Institute's success.

Maria D'Amico, who retired in August, dedicated several decades of her life to the institute, leaving an enduring legacy. As a beloved colleague, mentor, and friend to many, her tireless efforts have significantly shaped the institution, and her departure is marked by heartfelt gratitude from all who have had the privilege of working with her.

Additionally, Prof. Brian Havel, the former director of the institute, recently retired. Prof. Havel's visionary leadership has elevated the institute to global recognition, and his influence as a teacher and mentor has inspired countless individuals. His absence will undoubtedly be deeply felt, but his legacy will continue to thrive. He took the opportunity to remind the Institute of its legacy as the prime institution in the education of Air and Space Law and remarked his confidence in the continued success of the Institute under the leadership of Prof. Andrea Harrington and Prof. Vincent Correia.

Dean Robert Leckey, who delivered some opening remarks, expressed his confidence in the new leadership of the Institute and highlighted its excellence in the education of Air and Space Law.

As the institute bids farewell to the past, it warmly welcomes two new co-directors, Prof. Andrea Harrington and Prof. Vincent Correia. Both directors bring a wealth of knowledge, experience, and innovative perspectives that promise to further elevate the institute's global reputation.

Under their leadership, the Institute of Air and Space Law will continue its mission of nurturing the next generation of legal scholars and practitioners in the fields of air and space law.

Changes at the Helm of the IASL

The McGill Institute of Air and Space Law is pleased to announce that Prof. Vincent Correia and Professor Andrea Herrington have commenced their appointment as Co-Directors of Institute as of today, August 1st. They take over the helm of the IASL from Prof. Donal Hanley, who has ably and thoughtfully steered the affairs of the Institute as Interim Director over the past year.

Specialized in aviation law, Vincent Correia was a full professor of public law at the Université de Paris-Saclay. His research focuses on the interactions between international air law and national and regional legislation, from a multi-level perspective. He has been a visiting professor at Leiden University (Netherlands) for almost a decade and intervened as a guest lecturer at several universities throughout the world. He is fluent in French, English, and Spanish. He is co-editor of the Revue française de droit aérien et spatial and a member of the editorial boards of the Aviation and Space Journal and the Air & Space Law. He is member of the boards of the European Air Law Association and of the Société française de droit aérien et spatial. In recent years, he collaborated with several governments, airlines, aircraft manufacturers and law firms as a consultant. He holds a doctorate in public law and a master’s degree in European Community law from Bordeaux University, and a bachelor of law from Bordeaux University and the University of Salamanca.

Andrea Harrington served as the dean of space education at Air University. She leads Guardian Education development efforts for the United States Space Force (USSF), including the set-up of USSF graduate programs at Johns Hopkins School of Advanced International Studies in Washington DC. Previously, she served as chair of the Department of Spacepower and director of the Schriever Space Scholars concentration at Air Command and Staff College, where she is a full professor. She serves as a member of the editorial board for the McGill Annals of Air and Space Law, New Space Journal, and the American Bar Association publication The Air and Space Lawyer. She is a licensed attorney in Massachusetts. She served as associate director of the University of Mississippi Air and Space Law programs and associate chair for the Policy, Economics, and Law Department in the International Space University’s Space Studies Program. She holds a DCL and LLM from McGill, a JD from the University of Connecticut, an MSc in European Politics and Governance from the London School of Economics, and a BA from Boston University.

“We are honoured to inscribe our names in continuation of the list of our illustrious predecessors and colleagues.” the two new Co-Directors said. “We are also thankful and indebted towards Dr. Donal Patrick Hanley who served as Interim Director. His positive contributions to the reputation and future of the Institute after taking over from Professor Brian Havel leave us a wide path to success moving forward. We are delighted that he will continue working with us as Associate Professor and Associate Director” they added.

Competition Law Seminar on Enforcement vs the Policy Goal of an International Aviation Hub

On 18 July 2023, the Institute hosted a guest seminar by Professor Jae Woon (June) Lee, LLM (Air & Space Law) ’05, of the Chinese University of Hong Kong.

Titled "Competition Law Enforcement vs The Policy Goal of an International Aviation Hub," the seminar provided a detailed examination of the complex interplay between the enforcement of competition law and the strategic goal of creating an international aviation hub. Professor Lee underscored this intricate nexus by reviewing case studies from Singapore, Korea, and Hong Kong, showcasing the convergence and divergence of competition law, aviation law, and economic policy goals. The seminar concluded with a lively discussion on the crossroads of competition and aviation laws and the different manifestations of this relationship as various countries aspire to establish aviation hubs and promote their 'national champion' airline. In conclusion, Professor Lee questioned the conventional wisdom that connects the development of aviation hubs to the promotion of national airlines. He highlighted that while these two policy objectives may partially overlap, the strategies to achieve these goals remain distinct.

Professor Andrea Harrington, incoming Co-Director of the Institute, introduced Professor Lee. The audience included representatives from the International Civil Aviation Organization (ICAO), two national delegations to ICAO, and Air Canada. The Institute notes with special appreciation the attendance of Michael Gill, Director of the ICAO Legal Affairs and External Relations Bureau, Miju Hyun and Sang Heon Lee from the Korean Delegation to ICAO, and Francisco Uzieda from the Chilean Delegation to ICAO.

 


First Major McGill Manual Engagement Event held in Berlin

Participants at the Conference on the “McGill Manual on International Law Applicable to Military Uses of Outer Space” organised by the Directorate-General of Legal Affairs of the German Federal Ministry of Defence at Schönhausen Palace in Berlin, Germany.

On 21-23 June 2023, the Directorate-General of Legal Affairs of the German Federal Ministry of Defence hosted the Conference on the “McGill Manual on International Law Applicable to Military Uses of Outer Space” (MILAMOS). The three-day event was organised at the Federal Academy for Security Policy (Bundesakademie für Sicherheitspolitik, BAKS), and held at the historic Schönhausen Palace in Berlin, Germany.

Taking part at the Conference were officials and experts from the German Ministry of Defence, as well as from Australia, Belgium, Canada, France, Ireland, Japan, Lithuania, New Zealand, Poland, the United Kingdom, and the United States. The participation of such a diverse group of practitioners and academics from various parts of the world underlines the global interest in the McGill Manual, the world’s first manual clarifying the international law applicable to military uses of outer space during peacetime and time of rising tensions .

In attendance were Co-Editors of the McGill Manual Professor Ram Jakhu and Professor Steven Freeland, Managing Editor Mr. Kuan-Wei Chen and Research Coordinator Mr. Bayar Goswami. They were also joined by Ms. Svenja Berrang, Dr. Rada Popova, Mr. Ulf Häussler and Mr. Jérémie Ayadi, who as MILAMOS experts have over the years volunteered their valuable expertise and time in the consensus-forming and rule-drafting process.

Opening the Conference, Dr. Jan Stöß, Director General for Legal Affairs of the German Ministry of Defence, underlined the value of the McGill Manual in identifying and closing normative gaps in the peaceful exploration and use of outer space. The collective efforts of 100 experts, contributors and practitioners from all over the world serves as a tool to reduce miscalculation and misunderstanding in a shared domain of socio-economic and strategic importance.

Lt. Gen. Kai Rohrschneider, Director General for Forces Policy and Commissioner for Space of the German Ministry of Defence also welcomed the participants, and said that the world is at a Zeitenwende (turning point), a moment when we need to adjust to the realities of the military aggression in Ukraine, and threats to the rule-based international order. In such a climate, conducting military activities within existing legal frameworks, as well as fostering cooperation and dialogue to clarify laws are vital to preventing conflicts in space and to promoting the safe and responsible use of outer space.

In his opening remarks, McGill Manual Project Director and Co-Editor Professor Jakhu expressed his gratitude to the Government of Germany for its unwavering support and confidence in this unique international collaborative effort throughout the years. Since the very beginning of the MILAMOS Project, the Government of Germany has continuously supported the participation of Associate Expert Ms. Berrang and Core Expert Mr. Häussler in the consensus-forming and rule-drafting process. In May 2019, the German Ministry of Defence generously hosted the seventh MILAMOS Workshop in Berlin. It is thus with great humility the experts involved in the drafting of the McGill Manual return to Berlin at the invitation of the German Ministry of Defence with 52 Rules that formed the backbone of engaging discussions at the Conference.

McGill Manual Co-Editor Professor Freeland underlined that the McGill Manual provides a solid basis for important discussions on to ensure the continued safety, stability and sustainability of outer space. Such discussions are vital particularly in a domain in which military and civilian uses are closely intertwined. Professor Freeland also skilfully chaired the sessions and stimulating discussions throughout the three days of the Conference.

Professor Stephan Hobe, Director of the Institute of Air, Space and Cyber Law of the University of Cologne, a Partner Institution of the MILAMOS Project, also gave a welcome address in which he underlined that the current state of the world is a sobering moment for international law. It is hoped that the McGill Manual will further dialogue to prevent escalation and the extension of conflict into outer space that will ultimately have detrimental impact on all space operators and users.

The Conference was composed of four sessions, focused, respectively, on Rights and Obligations of Space Actors, Interference with Space Activities, Use of Force and Possible Reactions, and Liability and Responsibility. Each session was opened with keynote speeches from experts involved in the drafting of McGill Manual and practitioners from the German Space Agency DLR, the German Bundeswehr Space Command, the German Cyber and Information Domain Services Headquarter and the German Aerospace Industries Association (BDLI).

Such a unique set-up allowed the participants to understand the rationale behind and content of relevant rules of the McGill Manual, and allowed operators in the military, space agency and industry to share their valuable insight from practical experiences and challenges that arise from their day-to-day work in the field. Through the Q&A sessions, participants had ample opportunities to exchange perspectives on such pressing matters as what are the red lines that amount to a use of force given that the ways and means to interfere with space objects and the space infrastructure have grown in number and sophistication.

In an increasingly multipolar world, and at a time when the international community is faced with apparent assaults on international law and threats to the global rules-based order, there is even greater need to objectively clarify the law applicable to military space activities during peacetime for underlining the limitations international law places on the threat or use of force in outer space. It is vital that every member of the international community has, at the very least, a common understanding of what the law is, what is permissible, and what is prohibited in order to avoid misunderstanding, miscalculation, and escalation into conflict. Moreover, it is imperative that the international community take steps to enhance the existing global space governance system to address new and emerging challenges on Earth and in outer space. Indeed, both the Government of Germany and participants in the McGill Manual regard “outer space as a global commons to be used for the benefit of all States” and steadfastly share the belief that all efforts must be made to prevent a destructive conflict in space.

Future generations will thank them", commented Professor Donal Hanley, Interim Director of the Institute of Air and Space Law.

The Conference was the first major international engagement event since the publication of Volume I of the McGill Manual in July 2022. Throughout the drafting of the McGill Manual, concerted efforts have been made to engage officials and the general public about the importance of clarifying and cementing the rule of law in outer space. In May 2022, preliminary findings of the McGill Manual were presented to delegates of the Open Ended Working Group on Space Threats. A webinar was held jointly with the African Space Leadership Institute in March 2023, and in April 2023, an engagement event was with the Space Command of the Ministry of the Armed Forces of France. In July, there will be a meeting with officials of the Republic of Korea to present outcomes and exchange views.

The exchanges at such stakeholder engagement events are of importance to ensure that the commentaries to the McGill Manual accurately reflect a variety of perspectives on the state of international law as it applies to space activities, including military space activities, in peacetime as well as time of rising tensions. More engagement events are being planned as the McGill Manual team continue their efforts to socialise governments and space stakeholders on how the continued safe, secure and sustainable exploration and use of outer space must rest on commonly agreed legal principles.

Volume II of the McGill Manual, containing commentaries to the 52 Rules, is being finalised and is scheduled for completion at the end of 2023. The McGill Manual is in the process of being translated into all 6 official languages of the United Nations, and will also be available in Japanese, Korean and Turkish. Such efforts will make the McGill Manual available to a broad cross-section to the international community and the public at large.

 


 

 

Emeritus Professor Armand de Mestral

It is with great sadness that we learned of the death of Armand de Mestral.

In addition to all his other achievements in the main Faculty of Law and beyond, we at the Institute of Air and Space Law remember him for his long association with and support for our institute, most notably for his role as interim director from 1998 to 2000 in succession to Michael Milde before him and before the appointment of Paul Dempsey after him.

Even after his interim directorship ended, he remained active mentoring colleagues and supervising students of the institute. His last illness prevented him from being as active as he and we should have liked.

We are grateful for his generosity with his time and expertise and for his friendly and polite way of interacting with us all. To his widow and family we offer our deepest sympathies. May he rest in peace.

Conference on International Aviation + Space Financing Law: A Resounding Success

The recently concluded Conference on International Aviation + Space Financing Law, organized by the McGill Institute of Air and Space Law and the National University of Singapore's Centre for Banking and Finance Law, proved to be a great success. Held in the vibrant city of Singapore, this conference brought together an array of stakeholders from both academia and practice to explore the challenges, changes, and innovations in the field. The event was highly anticipated and garnered significant attention from experts in the aviation and space financing sectors.

The conference featured a thought-provoking keynote lecture delivered by Prof. Maria Chiara Malaguti, President of UNIDROIT. Her lecture explored the key challenges and developments within the Cape Town Regime, providing valuable insights into the evolving landscape of this field. Prof. Malaguti's expertise and knowledge set the tone for the engaging discussions that followed throughout the conference.

In addition to the keynote lecture, the conference included a special presentation titled "Frontiers of International Asset Finance: Drones, Spaceships, and the Cape Town Convention." This presentation was delivered by Mr. Stefan-Michael Wedenig, the Executive Director of the Institute and Centre of Air and Space Law, and Mr. Jack Wright Nelson, Editor of the Annals of Air and Space Law. Their insightful discussion delved into the implications of new technologies and the relevance of the Cape Town Convention in the context of international asset finance. The presentation provided attendees with further perspectives on the cutting-edge developments in the field.

The Conference attracted a diverse range of participants, including legal professionals, academics, industry experts, and government representatives. This varied mix of stakeholders fostered dynamic conversations and provided a broad perspective on the challenges and opportunities in aviation and space financing law.

Throughout the event, a series of thematic panels and interactive sessions covered topics such as regulatory frameworks, financing trends, emerging technologies, and the role of international conventions. Experts from around the world presented their research findings and shared their practical experiences, offering valuable insights into the evolving legal landscape of aviation and space financing.

We extend our (heartfelt) gratitude to the National University of Singapore and the Centre for Banking and Finance Law led by Prof. Dora Neo, and her staff Sandra, Rowena and Jothi, for their invaluable support in co-hosting the conference. Further, we would like to thank our knowledgeable speakers and engaging moderators who kindly shared their expertise and lent their time valuable time to the conference. The Institute also highly appreciated the attendance of Mr. Dan Behar (First Officer and Trade Commissioner - Canadian High Commission to Singapore) and Mr. René Sylvestre (Chef de poste - Bureau du Québec Singapour)

After a full academic year of hard work on this by all involved, we are delighted to share that the McGill Institute of Air and Space Law signed Memorandum of Understanding for a jointly offered course with The International Civil Aviation Organization at its GISS 2023 in Seoul, Korea.

IASL Students win the 14th Leiden-Sarin International Air Law Moot Court Competition

The McGill University Institute of Air and Space was proud to participate this year in the 14thLeiden-Sarin International Air Law Moot Court Competition, which was hosted by Leiden University in the Netherlands. The IASL was represented by our current graduate LL.M. students - Matthew Orsmbee (United States), Laura Triana Castano (Colombia), Judith Jahnke (Sweden), and coached by René David-Cooper (Doctoral candidate/Canada).

This year's case dealt with a dispute between two States following a cyberattack which allegedly contributed to a deadly mid-air collision between two airliners. The dispute raised questions of public international air law pertaining to the use of weapons against civil aircraft, State responsibility, dual registration of aircraft, breaches of an air services agreement, as well as claims regarding the independence and impartiality of ICAO. The team worked relentlessly throughout the 2022-23 academic year to draft factums, and participated in countless practices to develop and refine their oral pleadings in preparation for the in-person competition .

In the preliminary rounds, the IASL team faced off against teams from China, Indonesia, Turkey in France. Upon cumulating the total scores for all teams, the IASL team made it to the finals where it represented the respondent, which arguably had the hardest position to defend, against the applicants – represented by the University of Cologne. Both teams argued before a panel of three esteemed judges: Jeffrey Shane (former General Counsel/International Air Transport Association), Marc Nichols (General Counsel/Federal Aviation Administration) and Dr. Gérardine Goh Escolar (Deputy Secretary General of the Permanent Bureau of the Hague Conference on Private International Law).

During the finals, the IASL delivered a performance for the ages and demonstrated textbook oratorical art by captivating the bench and the audience with laser-sharp arguments, rebuttals and responses to challenging questions from the bench. Upon deliberation, the IASL team was awarded first place in the international competition and scored a hat-trick by also being awarded Best Memorial (Respondent) and Best Oral Pleadings (Applicants).

Matthew Ormsbee shared his experience with us:

We prepared tirelessly for eight months for this competition, reviewing the case file, researching the law, drafting two lengthy memorials, reviewing opponents' memorials, preparing and practicing our oral arguments, and bringing all our materials to Leiden. This was no small task. However, with the help of our coach, Rene David-Cooper, and the support of the entire Institute, every task was made simpler. It was a real team effort, and I couldn't have asked for better teammates with Judith Jahnke and Laura Triana. In many ways, this competition was the unofficial capstone of my LL.M. experience.

It was a roller coaster of emotions: we had great opponents from China, Indonesia, Turkey, and France (and eventually Germany in the final round). Without immediate feedback from the judges, it was hard to know how we were doing. Some of the rounds were very difficult, with questions coming non-stop from the judges. We did our best, but it was sometimes impossible to know if we were performing well all the time. Leiden University was an excellent host. The professors, students, and administrators showed us incredible hospitality and made the entire competition and conference a pleasure. I'm thankful to have such stellar colleagues across the Atlantic.

René David-Cooper, coach of this year's team echoed the sentiment and added:

I am very proud to have coached this fine group of individuals. Their performance in this competition reflected the team’s high level of preparation and resilience when faced with difficult positions to argue. We truly had a special team this year: three students with distinct backgrounds from three different continents came together and developed an unparalleled synergy. Their strong teamwork, along with their passion for air law and commitment throughout the academic year were key elements of our success this year. We hope to replicate this team-oriented approach when defending our title next year in Mexico City.

McGill Manual Engagement Seminar with the French Space Command

On 21 April 2023, the Co-Editors of the McGill Manual on International Law Applicable to Military Uses of Outer Space, Professor Ram Jakhu and Professor Steven Freeland, joined by Managing Editor Kuan-Wei Chen, held an engagement seminar with the Space Command of the Ministry of the Armed Forces of France.

Chief Commissioner Anne-Sophie Grand-Jacquot of the French Space Command (Commandement de l’Espace) kindly welcomed the editors of the McGill Manual to the impressive facilities of L’Hexagone Balard, the headquarters of the Ministry of the Armed Forces in Paris. Underlining the importance that France places on the safety and sustainability of outer space, Commissioner Grand-Jacquot recognised and praised the accomplishments and efforts of the Group of Experts that cumulated in the publication of the world’s first manual clarifying the law as it applies to military and strategic uses of outer space.

In attendance in person and online were over twenty military officers and attachés. Over two hours, the McGill Manual Co-Editors and Managing Editor took the time to address a dozen questions French Space Command had submitted beforehand. These questions ranged from seeking clarification on the definition and delimitation of outer space to the notion of “jurisdiction and control” over objects involved in military space activities. Members of the French Space Command were also keenly interested to have clarification on the content of the obligation of due regard, and how the physical and legal nature of outer space affects the exercise of the inherent right to self-defence. These insightful requests for clarification demonstrate the meticulous way that French government and officials have considered the 52 Rules contained in Volume I of the McGill Manual.

These Rules of the McGill Manual are the result of a long and extensive process of deliberation, consultation and review by legal and technical experts around the world. From the launch of the project to draft the McGill Manual, the Government of France has expressed great interest in the progress of the project to draft the McGill Manual. In turn, the project has greatly benefited from the involvement of Major Jérémie Ayadi and Major Mickael Dupenloup, who participated in their personal capacities and, with their astute interventions and input, provided much insight on military operations and perspectives.

Co-Editors Professor Jakhu and Professor Freeland both expressed their appreciation to their continued support and faith in the practical value of the McGill Manual. Underlining that outer space is governed by an established legal framework which guarantees the freedom of exploration and use for all, France’s 2019 Space Defence Strategy aligns greatly with the vision of the McGill Manual. In line with the rationale of the McGill Manual to clarify the law, the French Space Defence Strategy provides that “the free use of space is not absolute [since] it is curtailed by the requirement to respect ‘the interests of all countries’ and by international law”. Further, in March 2023, at the Open-Ended Working Group on Space Threats, the Permanent Representative of France to the Conference on Disarmament reiterated that “France remains committed to preserving a safe space environment and to the compliance with international law, which is fully applicable to space activities”.

Such sentiments greatly validate the urgency and value of the clarification of the lex lata in a shared operational environment that is increasingly congested, competitive and complex, and in which a variety of kinetic and non-kinetic means to interfere with or disrupt the space infrastructure may have lingering implications. Indeed, France had astutely observed that “States and the different actors now face an increase and intensification of mixed strategies, harassment methods and shows of force. These current and recurring threats, …are played out just short of the use of force”.

The engagement seminar with the French Space Command foreshadows the long-awaited publication of Volume II of the McGill Manual. Due to be made available in late 2023, Volume II contains detailed and evidence-based commentaries to the Rules, which relies on primary sources of international law, the travaux préparatoires of the instruments applicable to outer space, statements expressed by States on space activities and jurisprudence of international courts and tribunals, to clarify, for instance, what is meant by the threat or use of force in space. Other important pressing matters of concern to space operators and States that are also clarified in the McGill Manual are the legitimate responses are to internationally wrongful or unfriendly acts involving the use of the space infrastructure, and what the law is with regard to such space-specific operations such as rendezvous and proximity operations (RPOs) and the intentional jamming and spoofing of communications signals.

This unique opportunity to meet and engage with officials from the Ministry and the French Space Command was kindly facilitated by Director of the Foundation pour la recherche stratégique (FRS) Dr. Xavier Pasco, Director of Research of the French National Centre for Scientific Research (Centre national de la recherche scientifique) Dr. Isavelle Sourbes-Verger, and Ms. Florence Gaillard-Sborowsky (FRS). In concluding the seminar, Dr. Pasco praised the McGill Manual as an important “living entity” that reminds States and stakeholders of the firm legal foundations applicable to outer space and to all sorts of space activities and applications that are rapidly developing.

In March 2023, the Co-Editors of the McGill Manual co-hosted a webinar with the African Space Leadership Institute (ASLI) titled the “Governance of Military Space Activities: The McGill Manual”. In June 2023, the German Federal Academy for Security Policy will organise a conference to highlight the contents of the McGill Manual to officials and stakeholders of Germany and European States.

Further engagement and outreach events planned in the coming period will, similar to the seminar held with the French Space Command be instrumental to publicising and [familiarising] socialising States and space stakeholders on the continued relevance of the legal fundamentals of the space governance regime and the rule of law that underpin the continued safe, secure and sustainable exploration and use of outer space by all States.

On the eve of the 13th Annual McGill/PEOPIL Conference on International Aviation Liability, Insurance & Finance, the IASL European Alumni/ae Association held its reunion event. Forty friends, colleagues and graduates of the Institute met up at this long-anticipated event in the dazzling city of Paris.

The event was the first in-person reunion of the Association since 2014. The reunion began with a visit to the new facilities of the European Space Agency, and the traditional alumni/alumnae workshop, at which graduates shared with one another their personal and professional accomplishments, and reminisced about their life-enriching time at their alma mater in Montreal. At the meeting, Professor Ram Jakhu made a presentation on the current space law issues. Mr. André Farand, an alumnus of the IASL, shared his over 30 years of experience of work as the Former Head of ESA Legal Services Division. This was followed up with the evening cocktail and dinner which took place at the splendid Aeroclub de France just a few blocks from the Arc de Triomphe.

In a heart-felt speech, Anne-Karine Matte, daughter of the late Director Emeritus Nicolas Mateesco Matte, took the opportunity to express her appreciation to those who studied under and worked with Dr. Matte for being such a precious extension of her family.

Newly elected IASL European Alumni/ae Association president Ms. Isabelle Lelieur (LLM, 2000) welcomed the attendees of the meeting, and expressed her vision for a revival of the Association’s activities, and more robust engagement events and connections with IASL graduates spread all over Europe and beyond. After carefully deliberations with members, Isabelle announced Toulouse as the chosen city where the next biennial IASL alumni meeting will take place, and that Ms. Axelle Cartier (LLM, 1997) will be the president-elect for the 2025 meeting.

Axelle took to the stage to describe the long and intimate history “La ville rose” has with aviation and the aerospace industry. It is the city where la compagnie générale de l’Aéropostale first took off in 1918. Today, Toulouse is home to pioneering aerospace industry giants, including Airbus, ATR, Thales, and Collins Aerospace, and is also where the French space agency CNES and the Armée de l’Air et de l’Espace (French Air and Space Force) are based. In terms of ties to academia, Toulouse is the seat of the interdisciplinary Académie de l’Air et de l’Espace, and air law courses are taught at the prestigious Ecole National de l’Aviation Civile (ENAC) and Université Toulouse I Capitole. Last but not least, Toulouse is the gastronomy capital of the Sud-Ouest, as well as a rugby heaven with the local “Rouge et Noir” team. Toulouse-based aerospace giant Airbus and Stade Toulousain just celebrated the 40th anniversary of their partnership.

Toulouse will also have a more intimate tie with Montreal, as Air Canada will begin operating a direct service between the two cities in June this year. As the President-elect of the Toulouse meeting, Axelle will work closely with the rich network of graduates in Toulouse to ensure the success of the next Association reunion.

The European Association meeting was also an occasion to honour Ms. Maria D’Amico, who has been with the Institute for over 45 years. Having known generations of students and worked closely with a succession of IASL directors, including Professor Matte, Maria is truly the heart of the Institute whose dedication to the Institute and warmth will be fondly missed when she retires in May. The Association presented Maria a custom-made Delft Blue porcelain plate with the words “Merci! 45 year with IASL” engraved on it. The beautifully crafted memorabilia features a bird, symbolising her grace as well as her tireless contributions to helping the next generation take off in their careers.

As always, such reunions of the IASL alumni are memorable opportunities for old and new graduates to connect and network in an informal and familiar setting. Throughout the world, the Institute is delighted to see the remarkable achievements and successes of IASL graduates who are connected through lifetime bonds that were established in Montreal and at the Institute.


IASL Students participate in the 2023 Planetary Defense Conference

On the 6th of April 2023, two of our master's students, Judith Jahnke and Sanchi Dhamija, gave presentations at the 2023 Planetary Defense Conference, which is held biennially and brings together experts from the planetary defence community, including scientists and policymakers. This year, the conference was held at the UNOOSA headquarters in Vienna, Austria. The presentations covered a range of topics, including the latest scientific findings from the DARTmission, disaster management, and various impact scenarios, offering our students a unique opportunity to explore multiple aspects of this field.

During the conference, our students delivered two presentations on the complex legal issues surrounding planetary defence mitigation. Judith Jahnke discussed the legal complexities that arise when private actors are involved and a planetary defence mission partially fails, resulting in an asteroid impact in a different state than originally anticipated. Sanchi Dhamija argued for the obligation of states to act when an asteroid threat is detected. Judith noted that presenting at such a prestigious and internationally recognized conference was a valuable experience.

On March 31st, 2023, the McGill Institute of Air and Space Law held a career day for this year's IASL students. The event was led by Arpad Szakal, a Principal Consultant at Cormis Partners, and also featured a guest lecture from Pierre Cardin, Senior Vice President Public Affairs Airbus Canada.

Arpad Szakal began the event by sharing his own experiences working with clients in the aviation industry and discussed the importance of legal professionals in ensuring the safe and efficient operation of airlines and other aviation companies. He coached the students on how to highlight their experiences, efficiently conduct job interviews and successfully negotiate employment.

Following Szakal's presentation, Pierre Cardin delivered a guest lecture on the future of commercial aviation. He shared insights into the emerging technologies that are transforming the industry, such as electric aircraft and autonomous flight systems. Cardin also discussed the environmental challenges facing the aviation industry and Airbus's efforts to develop sustainable aviation technologies. He provided an overview of Airbus's operations in Canada and highlighted the importance between industry and academia.

After the presentations, students had the opportunity to ask questions and engage in discussions with the speakers.

The career day at the McGill Institute of Air and Space Law provided students with valuable insights into the legal and technological issues facing the aviation and aerospace industries and prepared them for their future in the industry.

"The event showcased the Institute's commitment to providing its students with access to industry experts and helping them develop the skills and knowledge needed to succeed in these dynamic fields." Interim Director, Prof. Donal Hanley said.

IASL Class visits ICAO

On March 30, 2023, the Institute’s students attended their Airline Business Law class, given by Sessional Lecturer George Petsikas, at nearby ICAO Headquarters. ICAO Secretary General Mr. Juan Carlos Salazar (IASL LL.M., 1999) greeted the class before Mr. Michael Gill, the Director of the Legal Affairs and External Relations Bureau, spent the morning giving the students a guest lecture about the main bodies of ICAO, the work of the ICAO Legal Committee, and environmental concerns and initiatives at ICAO.

Mr. Gill spoke in detail about the success and challenges of the Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA), sustainable aviation fuels, and the 2022 Long-Term Aspiration Goal. Among several areas of focus, ICAO prioritizes sustainable environmental objectives in civil aviation. Mr. Gill later escorted the class to the Assembly Hall, press and public balcony, and the ICAO Council chambers. Class representative, Major Matt Ormsbee of the United States Air Force, said that the entire class greatly appreciated Mr. Salazar’s and Mr. Gill’s expertise and time for the visit and guest lecture.

"We are very proud of our close relationship with ICAO dating back to the 1950s when they requested McGill University to set us up." Interim Director, Professor Donal Hanley said. "We are very grateful to Secretary General Juan-Carlos Salazar and Director Michael Gill for taking time out of their busy schedule for making this visit possible and spending so much time with our students", he added.

 

 


Guest Lecture by Professor Peter Nesgos

This Thursday this year's cohort participated in a guest lecture by IASL Adjunct Professor Peter Nesgos. Over three hours, Prof. Nesgos led an engaging discussion about space asset financing and insurance. "As the Institute of Air and Space Law we continuously strive to prepare our students for the fast changing space market. Prof. Nesgos, whose lecture has been part of our annual program for years, is always very kind in sharing his valuable knowledge with our students" Interim Director, Prof. Donal Hanley said. " I am grateful to my colleague, Prof. Ram Jakhu for facilitating this interesting lecture" he added.

The lecture was followed by a career Q&A session in which Prof. Nesgos shared his experience as a Partner of Milbank, a prestigious law firm with offices in New York.


Indonesian Delegation Visits IASL

On Thursday March 16th, a delegation from Indonesia consisting of His Excellency Mr. Daniel T.S. Simanjuntak, Indonesian Ambassador to Canada and Permanent Representative to the International Civil Aviation Organization (ICAO), Mr. Denon Prawiraatmadja, Chairman of the Indonesian National Air Carriers Association, Mr. Andre Rahadian, Partner at Dentons, as well as selected embassy employees, visited the McGill Institute of Air and Space Law, where they were met on behalf of Interim Director, Prof. Donal Hanley, by Executive Director, Stefan-Michael Wedenig, Editor of the Annals of Air and Space Law, Jack Wright Nelson, and Senior Administrative Assistant, Maria D’Amico.

During the meeting, the two sides discussed a range of issues related to air and space law, including regulatory frameworks, safety and security standards, and international cooperation. They explored possible areas of collaboration, such as joint research projects and the exchange of expertise and knowledge.

The Indonesian delegation praised the reputation of the Institute and expressed their appreciation for the warm welcome and hospitality extended to them. They commended the Institute for its contribution to the development of air and space law and its collaboration with international organizations such as ICAO and the United Nations Office for Outer Space Affairs (UNOOSA).

The delegation emphasised the importance of strengthening Indonesia's legal framework for aviation and space and expressed interest in deepening their cooperation with the Institute, exploring potential areas of collaboration such as joint research projects, academic exchanges, and capacity building activities to enhance the legal framework for air and space activities in Indonesia.

The Institute, in turn, expressed its readiness to assist Indonesia in these areas and highlighted its focus on promoting sustainable development in air and space law.

The meeting concluded with a commitment to further dialog and an invitation by the Indonesian delegation to the Institute, readily accepted, to visit Indonesia in June in conjunction with the upcoming Conference on International Aviation & Space Financing Law: Challenges, Changes, Innovations being jointly organized for Friday June 9th by the Institute with the Centre for Banking and Finance Law of the National University of Singapore at which Prof. Maria Chiara Malaguti, President of the International Institute for the Unification of Private Law, has graciously agreed to give the keynote address.

“The Institute frequently welcomes Indonesian students to our graduate programme, and we deeply value our relationship with Indonesia. I recall with pleasure prior visits to Jakarta to deal with Indonesian government officials and air carriers and was struck by their professionalism, warmth and courtesy on each occasion” Interim Director, Prof. Donal Hanley said, adding “I look forward to continuing the dialog during our conference in Singapore and our trip to Indonesia as part of our continued commitment to Asia”.


 

McGill Manual webinar with the African Space Leadership Institute

On 1 March 2023, the Institute of Air and Space Law co-hosted a webinar with the African Space Leadership Institute (ASLI) titled the “Governance of Military Space Activities: The McGill Manual”.

Professor Ram Jakhu and Professor Steven Freeland (Western Sydney University/Bond University), Co-Editors of the McGill Manual on International Law Applicable to Military Uses of Outer Space (McGill Manual), were joined by McGill Manual Core Expert Professor Setsuko Aoki (Keio University), McGill Manual Managing Editor Mr Kuan-Wei Chen, and McGill Manual Research Coordinator Mr. Bayar Goswami. For over two hours, the speakers highlighted the origins, scope, and significance of the world’s first manual clarifying the law as it applies to military and strategic uses of outer space.

The webinar, the third in an ASLI series on space sustainability, was attended by participants from many African countries and across the globe.

Through the webinar, ASLI and the McGill Institute hope to raise awareness on the importance of enhancing the rule of law and space governance, particularly related to military space activities. The McGill Manual will be a valuable tool to support continuing multilateral dialogue on disarmament, reducing space threats, and increasing confidence-building and transparency. In such important discussions, it is vital that the voices and needs of African States and peoples are represented and taken into account. In this light, participants took note of the inauguration of the African Space Agency, which will spur space research, space innovation, and enhance the progressive development of space governance across Africa.

ASLI Co-Founder Mr. Etim Offiong also took the opportunity to outline the mission of the African Space Leadership Institute. Founded in 2022, ASLI is an independent think-tank which aims to develop African space leaders and cultivate new talents and young space professionals through courses and public outreach events such as the webinar series. With the strong belief that space science and applications can be harnessed for African socio-economic development, ASLI aims to connect space expertise in Africa and internationally and enhancing capacity-building in space strategy, policy and law.

The webinar was the first public engagement event of the McGill Manual with a major space stakeholder in Africa. With the release of Volume I of the McGill Manual in 2022, concerted efforts are continually being made to engage and inform the public and space stakeholders on how the objective clarification of the rules and principles of space law will contribute to the sustainability, safety and security of outer space.

In May 2022, the McGill Manual was presented to delegates at the Open-Ended Working Group (OEWG) on reducing Space Threats through Norms, Rules and Principles of Responsible Behaviours. On 1st March 2023, at the 3rd Annual United States Space Command Legal Conference, McGill Manual Core Experts Mr. Gilles Doucet (Spectrum Space Security Inc.) and Lt. Col. John Goehring (United States Department of Defense) were invited to address the scope and value of the McGill Manual to military officials and space operators. They were joined by Col. Matt King (United States Department of Defense) and panel moderator Maj. Brian Green (United States Space Force), all of whom are graduates of the Institute.

In June 2023, the German Federal Academy for Security Policy will organise a conference to highlight the contents of the McGill Manual to officials and stakeholders of Germany and European States. Further engagement and outreach events are being planned in the coming period in the Middle East and East Asia. All efforts are being made to finalise Volume IIRules with Commentaries, which will be published by Springer in the second half of 2023.

Both Professor Jakhu and Mr. Offiong expressed the hope that the jointly organised webinar would be the first step to further opportunities for collaboration and exchange between the Institute of Air and Space Law and the African Space Leadership Institute.

The IASL was pleased to host Prof. Byers and Prof. Boley from the University of British Columbia for a guest lecture on February 16th. In front of an excited cohort, Prof. Byers and Prof. Boley delivered an interesting and engaging lecture based on their new book titled "Who Owns Outer Space?".

Winner of the 2022 Sarin-McGill Annual Student Essay Contest on Aircraft Finance & Leasing announced

Sarin & Co. and the Institute of Air and Space Law, McGill University are pleased to announce that Avani Gupta from the International Institute of Air and Space Law, Leiden University, has been adjudged as the winner of the Sarin-McGill Annual Essay Contest on Aircraft Finance and Leasing 2022.


We would like to thank students of law, from around the world, who participated in the contest and made it a grand success.


IASL Cohort visits Air Canada HQ

On 27 January 2022, a group of 25 students, consisting of the 2021, 2022 and 2023 cohorts, enjoyed the unique opportunity to visit the headquarters of Air Canada located at Montreal airport for a career field trip. Under the warm hospitality and guidance of employees at Air Canada, they were given a special tour of the crew training facilities, the maintenance hangar, the dangerous goods department as well as call centre operations and enjoyed lectures by seasoned professionals at the legal and regulatory affairs department and the network planning department of Canada's flag carrier. Students participated in simulated emergency situations, got a close-up view of dangerous goods (with appropriate safety precautions in place!) and could inspect a A330 which underwent scheduled maintenance.

The visit was a special occasion to learn about the fascinating issues and challenges of operating in the competitive airline industry. There, students gained first-hand understanding on how, through a variety of innovative business practices and careful management and planning, Air Canada is recognised as one of the top air carriers in North America. The visit was made possible with the kind assistance of IASL alumna and Adjunct Professor Martine de Serres and her colleague Rotem Bettoun who worked very hard to organise this field trip.

The class was accompanied by Interim Director Prof. Donal Hanley, Executive Director Stefan-Michael Wedenig, Editor of the Annals of Air & Space Law Jack Wright Nelson and IASL Research Associate Shakeel Ahmad.

IASL holds first Alumni Cocktail of 2023

The Institute of Air and Space Law Association (IASLA), the very active alumni network of the Institute of Air and Space Law (IASL), welcomed over 60 guests to its annual Holiday Party at the McGill Faculty Club on 25 January 2023, the first since COVID hit. The Holiday Party is one of the Institute’s great traditions and is also a wonderful opportunity for current LLMs, DCLs, Certificate students and post-docs to mingle with their predecessors at the IASL.

Short speeches were given this year by IASL Interim Director, Prof. Donal Hanley, Acting IASLA President, George Petsikas, and IASLA Chairman of the Board, Prof. John Saba. During his speech, Interim Director Hanley brought attention to the rich history and close relationship between the International Civil Aviation Organization (ICAO) and the IASL, which was founded in 1951 at McGill at the request of ICAO and the International Air Transport Association (IATA). Its first director was Dr John Cobb Cooper, later legal counsel to IATA.

The IASL was pleased and honoured to welcome the Secretary-General of ICAO, Juan Carlos Salazar, Director of the Legal Affairs and External Relations Bureau, Michael Gill as well as Dean of the Faculty of Law, Prof. Robert Leckey and Associate Dean, Prof. Tina Piper.

The reception was followed by a private dinner in honour of Prof. Randal Marlin who generously donated a painting to the Institute of the first Secretary-General of ICAO, Albert Ropert, painted by his mother, Hilda van Stockum, wife of the first Director of the External Relations Bureau, Ervin Ross “Spike” Marlin.

 

 


Major Milestone for IASL Student

Maj. Matthew Ormsbee being decorated by his family members at McGill University

The Institute of Air and Space Law celebrates the recent news of Major Matthew Ormsbee’s next military assignment. In August, Major Ormsbee will move to Colorado Springs, Colorado, where he will serve as an Assistant Professor of Law at the United States Air Force Academy. He expects to teach the introductory law class relating to U.S. constitutional law, criminal law and procedure, and the law of armed conflict. In addition, he will teach an upper-level course on space law and applications. He hopes to mentor students in moot court competitions, help lead conferences and symposia, and regularly publish on air and space law topics.

Major Ormsbee is excited and honored for this incredible opportunity, where he can share with students all that he has learned while at McGill University. He thanks Professor Ram Jakhu especially for his guidance and instruction on space law concepts, both in class and as his thesis supervisor. Major Ormsbee also hopes to continue a long history of collaboration between McGill University’s Faculty of Law and the U.S. Air Force Judge Advocate General’s Corps, the U.S. Air Force Academy, and the greater U.S. Air Force.

IASL Class attends 19th Annual Assad Kotaite

The IASL Class of 2022 and Adjunct Professor Ludwig Weber at the Faculty Club

The current IASL class attended the 19th Annual Assad Kotaite Lecture organised by the Royal Aeronautical Society (Montreal Branch) at the McGill Faculty Club. IASL Adjunct Professor Ludwig Weber accompanied the class and extended the invitation.


Kathy Fox, the Chair of the Transportation Safety Board of Canada delivered the insightful lecture on the topic "Evolving approaches to Managing Safety and Investigating Accidents; From Individual to Organizational Safety Management."
