Global Law of Monopolies, Human Rights and Access to Medicines

Résumé

[En anglais seulement] Professor Salomão Filho will try to demonstrate how, in the global arena, the effectiveness of human rights is frequently dependent upon the adoption of structural measures to curb market power of monopolies or big enterprises. In the case of the access to drugs, it can require the adoption of strategic litigation aiming at the compulsory licensing or the prevention of price abuse by patent holders. To illustrate this, he will discuss a case of strategic litigation regarding breast cancer drugs.

Le conférencier

[En anglais seulement] Calixto Salomão Filho is a Visiting Professor of Law at Yale Law School. He is currently a Professor of Law at University of São Paulo Law School and a Professor of Law at the Institut de Sciences Politiques (Sciences – Po), Paris, as the Gide Loyrette Nouel Chair of Law and Development.

His areas of specialty are antitrust law, economic law, and legal theory. He is especially interested in the historical evolution of economic power structures and their impact on the  legal and economic realm, as well as in the formulation of a comprehensive theory to understand and discipline these phenomena. He is the author of Monopolies and Underdevelopment: From Colonial Past to Global Reality (Elgar, 2015).
