Pearl Eliadis on parental rights vs. rights of health authorities | CBC News

November 3, 2022 | A Quebec superior court judge has authorized Sainte-Justine Hospital to extubate a 5 year old boy, who has been in a coma breathing with the help of a tube. In this case a young boy drowned and his parents wanted him to have certain medical treatment whereas the hospital said the treatment was not going to work and that the child will never recover. Professor Pearl Eliadis discussed that this is an issue of the conflict between parental rights and the rights of health authorities where a patient is not able to consent.

Professor Pearl Eliadis highlighted that the case was more unusual in the sense that, mostly when parents refuse pursue a treatment plan it's usually due to religion. Court doesn't give legal weight to religious concern in this particular case. Parents recently lost their case against the hospital and, since the interview, have gone on appeal of the decision.
