In the Hot Seat: Dealing with Corruption in International Arbitration

The McGill Journal of Dispute Resolution (MJDR) and the McGill Arbitration Student Society (MASS) invite you to learn from one of the foremost panels on international arbitration, featuring the Hon. L. Yves Fortier, Mr. Pierre Bienvenu, and Ms. Caline Mouawad, and hosted by Norton Rose Fulbright.

The panellists will discuss an overview of corruption in international arbitation. They will offer their perspectives on applicable evidentiary standards, and their views on the duty of tribunals and arbitrators to report suspicions of corruption and the enforceability of the agreements themselves.

The panel will be moderated by Prof. Andrea Bjorklund, Professor and Associate Dean (Graduate Studies) at the Faculty of Law, of McGill University and holder of the L. Yves Fortier Chair in International Arbitration and International Commercial Law.

About the speakers

The Hon. L. Yves Fortier, PC, CC, OQ, QC, AdE, LLD - Cabinet Yves Fortier
Yves Fortier is a past President of the London Court of International Arbitration and of the Canadian Bar Association. From 1984 to 1989, he was a member of the Permanent Court of Arbitration. From July 1988 until February 1992, he was Canada’s Ambassador and Permanent Representative to the United Nations. In 1989, he was President of the UN Security Council. From 1992 until 2008, he was Chairman of Norton Rose and then Chairman Emeritus until he began practicing as an independent mediator/arbitrator. From 2012 to 2015, Mr. Fortier was Chairman of the Sanctions Board of the World Bank. In 2013, Mr. Fortier was appointed to Canada’s Security and Intelligence Review Committee and sworn in as a member of the Privy Council. In August 2016, he was appointed Chairman of the Enforcement Committee of the European Bank for Reconstruction and Development (EBRD).

Pierre Bienvenu, AdE - Global Co-Head of International Arbitration, Senior Partner Norton Rose Fulbright Canada LLP
Mr. Bienvenu is a disputes lawyer with more than 30 years' experience, practising in international commercial arbitration, corporate and commercial litigation, and constitutional law. He has acted as counsel in numerous domestic and international arbitrations, both ad hoc and institutional. Mr. Bienvenu regularly serves as arbitrator in international arbitrations and has experience as sole arbitrator, party-appointed arbitrator and chairman of the tribunal. A former co-chair of the IBA’s Arbitration Committee, he is a an alternate member of the ICC International Court of Arbitration and a former member of the LCIA Court, of which he was also a vice-president. Until recently, he served as president of the LCIA’s North American Users’ Council. In 2013, he was presented with the Paul-André Crépeau Medal for his contribution to the international dimension of private law and commercial law in Canada.

Caline Mouawad - Partner, Chaffetz Lindsey LLP
Ms. Mouawad handles arbitrations involving claims and disputes relating to public and private international law issues, bilateral investment treaties, breach of contract, financial transactions, and privatization agreements. She is involved in complex arbitrations in a variety of sectors including insurance, telecommunications, oil and gas, energy and patent licensing. She has worked under the arbitration rules of several institutions, including the ICC, ICSID, LCIA, ICAC and AAA, as well as in ad hoc cases under the UNCITRAL Rules. Since February 2018, Ms Mouawad has served as a Vice Chair of the ICC’s Commission on Arbitration and ADR. Caline obtained her J.D. degree from Harvard Law School and her Bachelor of Arts degree from Rice University. She is a dual-qualified lawyer in New York and in Paris.
