Maintained Status Procedure

To receive a maintained status confirmation, the employee concerned must now personally send an email to immigration.apo [at] mcgill.ca.

The employee's departmental administrator must be added to the email in cc.

In their email, the employee must clearly answer the following questions relevant to their scenario and provide the documents listed below. An email will be sent back confirming maintained status. “Maintained status” was previously called "implied status". In the following scenarios, IRPR refers to the Immigration and Refugee Protection Regulations.

Scenario 1 : Work Permit Renewal (IRPR 186(u))

Questions Documents
  1. Have you traveled outside Canada since the expiry of your work permit?
  2. When did your work permit expire?
  3. When did you apply for your work permit renewal?
  4. Is the new work permit for the same position with the same conditions and salary? If not, please explain.
  1. Copy of expired work permit
  2. Evidence that the application for a new work permit was submitted before the expiry of the old work permit.
    • Online application: letter of confirmation from IRCC showing date of submission
    • Paper application: copy of application and postmark

Scenario 2 : Study Permit Renewal (IRPR 186(f)/(v) & 189)

Questions Documents
  1. Have you traveled outside Canada since the expiry of your study permit?
  2. When did your study permit expire?
  3. When did you apply for your study permit renewal?
  4. Are you enrolled as a full-time student?
  5. Have you graduated and will be starting a new program? If so, when did you complete your studies and when will your new program start?
  1. Copy of expired study permit
  2. Evidence that the application for a new study permit was submitted before the expiry of the old study permit
    • Online application: letter of confirmation from IRCC showing date of submission
    • Paper application: copy of application and postmark

Scenario 3 : Transition From Study Permit To Work Permit (IRPR 186(w))

Questions Documents
  1. When did you complete your studies?                                                                                           
  2. When does your study permit expire?
  3. When did you apply for your work permit?
  1. Copy of study permit
  2. Evidence that the application for a work permit was submitted before the expiry of the study permit
    • Online application: letter of confirmation from IRCC showing date of submission
    • Paper application: copy of application and postmark
  3. Evidence of study program completion: letter of completion, transcripts or diploma
